Agreement to Terms
These Terms of Service ("Terms") govern your use of the Sonoran 3D Scanning website and services. By accessing our website or engaging our services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our website or services.
Description of Services
Sonoran 3D Scanning provides 3D laser scanning and LiDAR services for commercial and industrial clients in the Phoenix, Arizona metropolitan area. Our services include:
- 3D laser scanning of commercial buildings and facilities
- LiDAR scanning for large sites and outdoor structures
- Point cloud data capture and processing
- As-built documentation and CAD drawing creation
- Deliverables in various formats (point cloud, CAD, BIM)
Important Service Limitations
Non-Certified Informational Deliverables Only: All deliverables provided by Sonoran 3D Scanning are non-certified informational documents. They are suitable for planning, visualization, and documentation purposes only.
Our services and deliverables are NOT intended for:
- Engineering certification or stamp
- Regulatory compliance or permit applications
- Legal boundary surveys or property line determination
- Construction documents requiring professional certification
- Any purpose requiring a licensed surveyor, engineer, or architect certification
If you require certified survey-grade measurements or engineering certification, we recommend engaging a licensed surveyor or engineer.
Accuracy and Data Quality
We use professional-grade laser scanning equipment and follow industry best practices for data collection and processing. Typical accuracy is within ±2-6mm at normal working ranges.
However, accuracy can be affected by various factors including:
- Environmental conditions (temperature, humidity, lighting)
- Surface properties (reflective, transparent, or absorbent materials)
- Site access and obstructions
- Movement during scanning
We do not guarantee any specific level of accuracy and recommend clients verify critical measurements independently for important decisions.
Client Responsibilities
When engaging our services, clients agree to:
- Provide accurate project information for quoting purposes
- Arrange safe and appropriate site access for our team
- Inform us of any known hazards or safety requirements
- Obtain necessary permissions or authorizations for scanning
- Provide timely feedback and approvals as needed
- Pay for services according to agreed payment terms
Intellectual Property and Data Ownership
Upon full payment for services:
- Client owns the deliverables (point clouds, drawings, models) created for their project
- Client may use deliverables for their intended business purposes
- We retain the right to use anonymized project information for marketing and quality improvement
We may retain copies of project data for a reasonable period for quality assurance and potential future client requests.
Payment Terms
Payment terms are specified in individual project proposals and may include:
- Deposit required before scheduling on-site scanning
- Balance due upon delivery of final deliverables
- Net 30 payment terms for established commercial accounts
Late payments may be subject to interest charges and may result in suspension of services.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability for any claim arising from our services shall not exceed the amount paid by client for the specific project giving rise to the claim
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We shall not be liable for damages arising from reliance on our deliverables for purposes beyond their intended scope (particularly certified or regulatory purposes)
- We shall not be liable for delays or failures caused by circumstances beyond our reasonable control
Some jurisdictions do not allow limitations of liability, so some of the above limitations may not apply to you.
Disclaimer of Warranties
OUR SERVICES AND DELIVERABLES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness of data
Cancellation and Refunds
Cancellation policies:
- Cancellations made more than 48 hours before scheduled scanning: Full refund of deposit (minus any non-recoverable costs)
- Cancellations made within 48 hours of scheduled scanning: Deposit may be forfeited or applied to rescheduled date
- Cancellations after scanning has begun: Payment due for work completed
Website Use
When using our website, you agree to:
- Provide accurate information in any forms you submit
- Use the website only for lawful purposes
- Not attempt to interfere with the website's operation
- Not use automated tools to scrape or collect content
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Maricopa County, Arizona.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.
